Menores infractores : resultados de la medida de internamiento en centro

Abstract

When a young under 18 commits a fault and it is reported to the police, the Ley Orgánica de Responsabilidad Penal del Menor (LORPM) 2000 takes place, with their maximum principle being the minor´s interest. This interest, can be operationalised in some cases in young offenders institutions, which means the maximum restriction of freedom that can be imposed by the psychologists and social workers in the Juvenile Court. Therefore, it is important to analyse which are the results on the minor´s social adaptation, of having been accommodated in a young offender institution. In order to attain this goal, 49 juvenile offenders who have been in custody, were selected from the data base of the Juvenile Court. From this sample, 17 minors (34% of the initial sample, with a mean age = 22) voluntary accepted to participate in the study. They were assessed with a semistructured interview (designed for this study), about their current state in different areas. In this research we will try to relate the custody and judicial system areas with individual and social variables of the juvenile offender. The results show significant correlations among different variables, mainly among the recidivism rate, quantity and quality of the custody, and individual variables of the juvenile. These results are discussed in relation to protection and risk factors, found in the minor and his/her environment

Cuando un menor de 18 años comete una falta y es denunciado, entra en acción la Ley Orgánica de Responsabilidad Penal del Menor (LORPM) del año 2000, cuyo principio fundamental es el interés del menor. Éste interés puede operativizarse en algunos casos en internamiento en centro, que constituye la medida educativa de máxima restricción de la libertad que puede recomendarse por parte del Equipo Técnico del Juzgado de Menores. Ante ello, cabe preguntarse cuáles son los resultados o posibles efectos a nivel de adaptación social del menor, de haber cumplido una medida de internamiento. Para ello, de la base de datos del Equipo Técnico de Menores, se seleccionaron 49 menores, que habían finalizado una medida de internamiento cerrado, semiabierto o abierto. De estos 50 menores, 17 (un 34 % de la muestra inicial, con una media de edad de 22 años) aceptaron participar voluntariamente en el estudio, administrándoles una entrevista semiestructurada (confeccionada especialmente para este estudio), acerca de la situación actual del sujeto en diferentes áreas. Mediante este estudio intentaremos relacionar las áreas vinculadas al internamiento en centro y al sistema judicial, con variables personales y sociales del sujeto. Los resultados muestran correlaciones significativas entre distintas variables, fundamentalmente entre la tasa de reincidencia, cantidad y calidad del internamiento, y variables individuales del menor. Estos resultados se comentan en torno a la existencia de factores de protección y de riesgo, en relación al menor y su entorno
