This paper analyses the controversy
between the Spanish State and the P&I Club The
London Steamship Owners Mutual Insurance
Association as a result of the incident suffered
on the Galician coast by the oil tanker Prestige
in 2002. Specifically, it addresses the conflicts of
jurisdiction that arose between arbitration and
jurisdiction due to the inclusion of an arbitration
clause in the insurance policy, which gave rise
to two parallel proceedings and two contradic-
tory rulings. It also examines the ongoing issue
of whether the Spanish Supreme Court judgment
can be recognised and enforced in the United
Kingdom, the possible responses of the CJEU to
the request for a preliminary ruling made by the
English High Court and the consequences this
may have in the future. [-]

El presente trabajo aborda el estudio de la controversia entre el Estado español y el Club de P&I The London Steamship Owners Mutual Insurance Association a raíz del siniestro sufrido en las costas gallegas por el buque petrolero Prestige, en el año 2002. Concretamente, se analizan los problemas de competencia que surgieron entre arbitraje y jurisdicción, como consecuencia de la inclusión de una cláusula arbitral en la póliza de seguro, y que dieron lugar a dos procedimientos paralelos y a dos resoluciones contradictorias. Asimismo, se examina el pro- blema, todavía presente, sobre la posibilidad de que la sentencia dictada por el Tribunal Supremo sea reconocida y ejecutada en el Reino Unido, las posibles respuestas del TJUE a la cuestión prejudicial planteada por la High Court inglesa y las consecuencias que ello puede provocar en un futuro.
