Perfil judicial y social del menor infractor: comparativa entre España y América del Sur.

Abstract

Los factores de riesgo del menor no solo son útiles para la propia prevención del delito sino que también son necesarios tanto para la elaboración de la norma penal como para el tratamiento que el menor necesita una vez se le ha impuesto una medida; es por ello que el objetivo principal de este trabajo se basa en conseguir analizar el perfil del menor infractor a través del análisis de varios estudios realizados en diversas comunidades autónomas y centros de menores por todo el territorio español. Se establecen así las principales características de los menores infractores nacionales, con el objetivo de compararlas con las características de los menores infractores de América del Sur, para establecer así las diferencias entre los perfiles de ambos. Los resultados han dejado ver que, por un lado las diferencias principales se encuentran en la edad mínima de imputabilidad y la imposición por parte de los Jueces de la privación de libertad en América del Sur como la medida más impuesta; por otro lado las similitudes entre ambos perfiles son que comúnmente se trata de menores varones nacionales del país donde delinquen, que han abandonado los estudios o están apunto de hacerlo y que cometen delitos contra la propiedad.

The risky factors of the minor are not only useful for the prevention of the crime itself, but they are also necessary both for the elaboration of the penal norm and for the treatment that the minor needs once a measure has been imposed on him/her; that is why the main objective of this work is based on managing to analyse the profile of the minor offender through the analysis of several studies carried out in various autonomous communities and centres for minors throughout Spain. In this way, the main characteristics of national juvenile offenders are established, with the aim of comparing them with the characteristics of South American juvenile offenders, in order to establish the differences between the profiles of both. The results have shown that, on the one hand, the main differences are found in the minimum age of criminal responsibility and the imposition by judges of deprivation of liberty in South America as the most imposed measure; on the other hand, the similarities between both profiles are that they are commonly male minors who are nationals of the country in which they commit the crime, who have abandoned their studies or are about to do so and who commit crimes against property.
