The risky factors of the minor are not only useful for the prevention of the crime
itself, but they are also necessary both for the elaboration of the penal norm and for the
treatment that the minor needs once a measure has been imposed on him/her; that is
why the main objective of this work is based on managing to analyse the profile of the
minor offender through the analysis of several studies carried out in various
autonomous communities and centres for minors throughout Spain. In this way, the
main characteristics of national juvenile offenders are established, with the aim of
comparing them with the characteristics of South American juvenile offenders, in order
to establish the differences between the profiles of both. The results have shown that,
on the one hand, the main differences are found in the minimum age of criminal
responsibility and the imposition by judges of deprivation of liberty in South America as
the most imposed measure; on the other hand, the similarities between both profiles
are that they are commonly male minors who are nationals of the country in which they
commit the crime, who have abandoned their studies or are about to do so and who
commit crimes against property. [-]
