Libertad de expresión: discurso del odio y desinformación

Abstract

Este trabajo de final de grado se centra en el derecho fundamental a la libertad de expresión, analizando su fundamento, legislación, así como la existencia y justificación de sus límites con derechos colindantes. Se tratará la especial relevancia de como afecta el discurso del odio a la sociedad, como se relaciona con el derecho a la libertad de expresión, su legislación y jurisprudencia relevante en el contexto español y europeo. En los últimos tiempos se han dado cambios relevantes en la forma en la que nos comunicamos, que desafían la concepción y garantía al derecho a la libertad de expresión tal como estaba configurada. Se analizará el impacto de las nuevas tecnologías de la información y comunicación, y en especial, la aparición de Internet. También se reflexionará acerca de como esta nueva realidad afecta al derecho a la información, conectando con el peligro de la aparición de las ‘Fake News’ y las campañas de desinformación, así como su relación con el discurso del odio y cómo este contexto puede desafiar tanto el derecho a la libertad de expresión como los valores democráticos.

This dissertation will focus on the fundamental right to freedom of speech, analyzing its bases, legislation, as well as the existence and justification of its limits with colliding rights. We will discuss the particular relevance of how the hate speech affects society, how it relates to the right to freedom of speech, its legislation and relevant jurisprudence in the Spanish and European context. In the present times, there has been relevant changes in the way we communicate, that challenges the conception and guarantee of the right to freedom of speech. We will analyze the impact of the new information technologies, and specially, the emergence of the Internet. We will also ponder about how this new reality affects the right to information, connecting with the dangers of the development of the ‘Fake News’ and the disinformation campaigns as well as its relation with the hate speech and how this connects can challenge the right to freedom of speech and the democratic values.
