This dissertation will focus on the fundamental right to freedom of speech, analyzing
its bases, legislation, as well as the existence and justification of its limits with colliding
rights.
We will discuss the particular relevance of how the hate speech affects society, how
it relates to the right to freedom of speech, its legislation and relevant jurisprudence in
the Spanish and European context. In the present times, there has been relevant
changes in the way we communicate, that challenges the conception and guarantee of
the right to freedom of speech. We will analyze the impact of the new information
technologies, and specially, the emergence of the Internet.
We will also ponder about how this new reality affects the right to information,
connecting with the dangers of the development of the ‘Fake News’ and the
disinformation campaigns as well as its relation with the hate speech and how this
connects can challenge the right to freedom of speech and the democratic values. [-]
