Las demandas de hacer algo (personalísimo y no personalísimo)

Abstract

The object of this paper is to highlight some of the problems that arise in practice when convictions to do something (personal or not) are to be enforced on their own terms, so that the litigant that has obtained a judgement can get the recognition of his/her claim and can benefit of an effective judicial protection.

l objeto de este trabajo es poner de manifiesto algunos de los problemas que se suscitan en la práctica cuando se han de ejecutar sentencias condenatorias a hacer algo (personalísimo o no) en sus propios términos, en aras a que, quien haya obtenido una sentencia que reconozca su pretensión, vea satisfecho su derecho a la tutela judicial efectiva.
