By custom, tenants on the Huerta of Valencia had property rights over the improvements that they carried out on the farms they worked. In this paper that custom is analysed with the aim of gaining a deeper understanding of a topic that has recently been receiving a great deal of attention from scholars concerned with economic institutions, namely, the fact that property rights are granted by the State through laws but, because the solutions offered by the State are not always the most efficient, individuals sometimes reach private agreements in order to find alternative solutionsca_CA
