El desarrollo de adecuados sistemas de solución extrajudicial de conflictos laborales ha sido una asignatura pendiente en nuestro sistema de relaciones laborales. La Ley 11/1994, que se ocupó del tema, quedó en un episodio sin continuidad legislativa de modo que el fomento normativo no reaparecerá hasta el RDL 10/2010 y, con él, la Ley 35/2010, el RDL 7/2011 y la LRJS. La reforma de 2012 desvirtúa dichos medios al establecer otros cauces que los neutralizan y valerse de vías de solución extrajudicial que han sido despojadas de su esencia voluntaria. [-]

The development of appropriate systems for the out-of-court settlement of labour disputes has been a subject pending in our labour relations system for some time. Spanish Law 11/1994, which addressed the matter, was finally left at a point with no legislative continuity, and thus any hint of ‘norm-building’ did not reappear until the passing of the RDL (Royal Decree Law) 10/2010 and, along with it, Law 35/2010, RDL 7/2011 and the LRJS (Law Governing Social Jurisdiction). The 2012 reform detracts from those means by establishing other channels that neutralise them and by using methods of out-of-court settlement that have been stripped of their essential voluntary nature.
