La aparición de nuevos sistemas de ayuda a la navegación como consecuencia de la innovación y el desarrollo tecnológico en el sector marítimo puede afectar también al régimen de responsabilidad civil por daños por contaminación marítima. Y es que el propietario o armador deja de responder cuando los daños se deban a una actuación negligente o lesiva del Gobierno o autoridad responsable del mantenimiento de luces u otras ayudas a la navegación en el ejercicio de dicha función. Tras un somero análisis del marco normativo aplicable, el presente trabajo aborda la posible problemática que podría derivarse al invocar esta causa de exoneración de responsabilidad, dada la necesidad de interpretar el término en inglés «navigational aids» contenido en los convenios internacionales conforme a la realidad social del momento en que ha de ser aplicado. The emergence of new navigational aids as a result of innovation and technological development in the maritime sector may also affect the civil liability regime for maritime pollution damage. The owner or shipowner is no longer liable when the damage is due to a negligent or harmful action by the Government or authority responsible for the maintenance of lights or other navigational aids in the exercise of that function. After a brief analysis of the applicable regulatory framework, this paper addresses the possible problems that could arise when invoking this ground for exoneration from liability, given the need to interpret the term «navigational aids» contained in the international conventions in accordance with the social reality of the time in which it is to be applied.
