El derecho al respeto a la vida privada y familiar, reconocido en el artículo 8 del Convenio Europeo de Derechos Humanos, juega un papel fundamental en la protección, no solo de la familia, sino también, en especial, de los derechos de los menores. En este contexto, la concreción del concepto “vida familiar” y de su alcance por parte del Tribunal Europeo de Derechos Humanos basado, entre otros, en la existencia y efectividad de lazos familiares, ha permitido determinar aspectos esenciales en relación con figuras como la adopción, la gestación por sustitución o la reagrupación familiar, como veremos. The right to respect for private and family life, recognised in Article 8 of the European Convention on Human Rights, plays a fundamental role in the protection, not only of the family, but also, in particular, of the rights of minors. In this context, the definition of the concept of "family life" and its scope provided by the European Court of Human Rights based, among otrhers, on the existence and effectiveness of family ties, has made it possible to determine essential aspects in relation to institutions such as adoption, surrogacy or family reunification, as we shall see.
