El RDL 3/2021 incorpora en la DT 33ª del TRLGSS un precepto que fija las reglas referidas a la compatibilidad entre el complemento por aportación demográfica y el complemento por brecha de género, de manera que se obliga a minorar en su cuantía uno de los estos dos complementos cuando comienza a percibirse el otro. El Alto Tribunal entiende que esta previsión es aplicable en el supuesto que aquí aparece; en cambio, el Voto particular que incorpora el pronunciamiento sostiene lo contrario, por cuanto el hecho causante del complemento minorado es anterior al RDL 3/2021. RDL 3/2021 incorporates in its DT 33 a precept that requires the reduction of the maternity supplement due to the demographic contribution that would be received if the other parent is later recognized with the supplement due to the gender gap. The High Court resolves that, in the particular case discussed here, the supplement must reduce its amount, but the dissenting opinion that incorporates the ruling maintains the opposite, since the causative event predates RDL 3/2021.
