El transporte sobre cubierta ha sido tradicionalmente excepcional porque
exponía las mercancías a grandes riesgos, pero a partir de la llamada
«revolución de los contenedores» ha devenido una práctica común del sector.
Este artículo analiza la responsabilidad del porteador por las mercancías
estibadas sobre cubierta a la luz de los convenios internacionales (Reglas de
La Haya y La Haya-Visby, Reglas de Hamburgo y Reglas de Rotterdam) y de la
Ley de Navegación Marítima de 2014. Se estudian dos problemas principales:
por un lado, cuándo el porteador está autorizado para estibar la carga sobre
cubierta; y, por otro, cómo responde cuando las mercancías se transportan a la
intemperie sin dicha autorización. Por último, se plantea la cuestión de si es
necesario que en el siglo XXI todavía existan normas especiales de
responsabilidad para la carga sobre cubierta. [-]

Deck stowage has been traditionally exceptional due to the great risks involved,
but after the so called «container revolution» it has become a common reality in
the modern shipping industrie. This paper deals with the carrier ́s liability for
deck cargo under the international conventions relating to the carriage of goods
by sea (Hague and Hague-Visby Rules, Hamburg Rules and Rotterdam Rules)
and the recent Spanish Maritime Navigation Act 2014. Two main problems are
addressed: on the one hand, when is the carrier authorised to stow cargo on
deck; on the other hand, which is the carrier ́s liability for deck cargo when it
has been stowed on deck without such authorisation. Finally, we discuss the
question whether an special liability regime for deck cargo is in the 21st century
still necessary. [-]
