La igualdad jurídica. Una aspiración histórica de la lucha femenina (1975-1981)

Abstract

The 20th November 1975 was a decisive date in the contemporary history of Spain. The death of the dictator put an end to a period characterised by repression and the absence of freedoms. Most of the population received the news with concern, given the unknown future that lay ahead and the fear of a revival of the civil conflict that ravaged the country between 1936 and 1939. Fortunately, these predictions did not come true. On the contrary, consensus reigned among the main political forces, and the opportunity was seized to establish a democratic system in which the fundamental rights of citizens were guaranteed. At this juncture, it is worth highlighting the arduous work that was carried out for the configuration of an egalitarian legal system that would leave behind discrimination against women, both in the public sphere and in the family and private spheres. This research has been devoted to the latter issue, delving into the work of outstanding jurists such as María Telo Núñez, who participated in two transcendental modifications of the Civil Code, on the one hand, the one carried out in 1975 and, on the other, the one that involved the reintroduction of the institution of divorce in Spain.

El 20 de noviembre de 1975 constituyó una fecha determinante en la historia contemporánea española. La muerte del dictador ponía fin a un periodo caracterizado por la represión y la ausencia de libertades. La mayor parte de la población recibió la noticia con inquietud, ante el futuro incierto que se avecinaba y el temor a que reviviese el conflicto civil que arrasó el país entre 1936 y 1939. Afortunadamente estos vaticinios no se cumplieron. Al contrario, reinó el consenso entre las principales fuerzas políticas, y la ocasión fue aprovechada para el establecimiento de un sistema democrático, en el que quedaron garantizados los derechos fundamentales de los ciudadanos. En esta coyuntura, destaca la ardua labor que se llevó a cabo para la configuración de un ordenamiento jurídico igualitario que dejase atrás la discriminación de la mujer, tanto en el espacio público como en el ámbito familiar o privado. A esta última cuestión se ha destinado la presente investigación, ahondando en el trabajo de juristas tan destacadas como María Telo Núñez, quien participó en dos modificaciones trascendentales del Código Civil, de un lado, la operada en 1975 y, de otro, la que implicó la reimplantación de la institución del divorcio en España.
