Este trabajo tiene por objeto poner de relieve la necesidad de una ley de cuidados paliativos en
España. Estos cuidados están unidos a la idea de muerte digna y sobre la regulación de los mismo parece
existir un cierto consenso. En España no existe todavía ninguna ley que regule los cuidados paliativos si bien
dos proposiciones de ley están tramitándose en las Cortes Generales. Por el contrario este mismo año se ha
aprobado la Ley Orgánica 3/2021, de 24 de marzo, de regulación de la eutanasia (en adelante LORE) sobre la
que existe profundas discrepancias como lo demuestran los dos recursos de inconstitucionalidad que ya se han
formulado sobre la misma. Esta misma división se reproduce sobre la función de los cuidados paliativos, puesto
que pueden funcionar como sustitutivos de la eutanasia o como complementarios a la misma. [-]

This paper aims to highlight the need for a state law on palliative care in Spain. These care is linked to
the idea of dignified death and there seems to be some consensus on its regulation. In Spain, there is still no state law
regulating palliative care, although two bills are being processed. It is also intended to contrast the possible palliative
care law with the existing law regulating euthanasia. On the contrary, this same year, Organic Law 3/2021, of March
24, regulating euthanasia (hereinafter LORE) was approved on which there are deep discrepancies as shown by the two
unconstitutionality appeals that have already been formulated. about it. This same division is reproduced on the role of
palliative care, since it can function as a substitute for euthanasia or as a complement to it. [-]
