Abstract

Este trabajo de fin de grado tiene por objeto abordar el recorrido constitucional de nuestro país hasta llegar a la Constitución de 1978, con el propósito de analizar los cambios que ha experimentado el Poder Judicial a lo largo de la historia constitucional española hasta llegar a la actualidad. Por ello, nos queremos centrar en el Consejo General del Poder Judicial, debido a que, desde su creación, ha experimentado diferentes reformas, muchas de ellas polémicas, las cuales han desencadenado diversas posturas dentro de la opinión pública, que no han cesado y que, actualmente, esta institución sigue siendo protagonista dentro del debate político y social. Para poder entender el origen de este órgano, contemplado en el artículo 122.2 y 3 de nuestra carta magna, hemos optado por hacer un repaso exhaustivo y así comprender el papel de esta institución, sus funciones, la designación de sus miembros y su forma de elección. Con el propósito de conocer más en profundidad el CGPJ, hemos optado por analizar las Asociaciones Profesionales, su régimen jurídico y el impacto asociativo de las mismas dentro de la judicatura, además, de hacer un repaso de las diferentes propuestas de los principales partidos políticos desde el año 2015. Todo ello lo haremos teniendo en cuenta el contexto actual, pues la falta de acuerdo en el Congreso de los Diputados, fruto de la intensa polarización política por la que España atraviesa, ha provocado que el CGPJ no haya sido renovado en los plazos establecidos, debido a que el actual se encuentra en funciones desde el año 2018.

The purpose of this final thesis is to address the constitutional path of our country up to the 1978 Constitution, with the aim of analyzing the changes that the Judicial Branch has undergone throughout history until the present day. Therefore, we intend to focus on the General Council of the Judiciary because since its creation it has suffered several reforms, many of them controversial, which have triggered a variety of positions still ongoing within public opinion and so nowadays this institution continues to be a protagonist in the political and social debate. In order to understand the origin of this institution, contemplated in article 122.2 and 122.3 of our Carta Magna and created in 1980, we have chosen to make an exhaustive review to understand its role, functions, the appointment of its members and how they are elected. With the purpose of knowing more in depth the GCJ, we have chosen to analyze the Professional Associations, their legal regime and their associative impact within the judiciary as well as reviewing the different proposals of the main political parties since 2015. We will do all this taking into account the current context since the lack of agreement in the Congress of Deputies as a result of the intense political polarization that Spain is going through, has meant that the GCJ has not been renewed within the established deadlines and so, it has been in office since 2018. In short, we intend to approach this institution taking into account the different constitutions that our country has had along its historical stages, in order to get to know the precedents that the General Council of the Judiciary has had until its creation so as to address issues related to this institution.
