La Reforma Laboral del año 2012, “Ley 3/2012, de 6 de julio, de medidas urgentes
para la reforma del mercado laboral”, supuso un antes y un después en el marco legal
del mercado de trabajo de España. Las medidas que se adoptaron en un momento tan
crítico de la economía cambiaron por completo la situación de los trabajadores y del
propio mercado laboral, que vieron como en el peor momento de la economía de las
últimas décadas, se modificaron y redujeron sus derechos en favor de una mejora en la
competitividad de las empresas. Estas pasaron a una posición aún más dominante
respecto a la figura del trabajador y donde solo se tuvo en cuenta que las empresas que
habían sobrevivido a la crisis iniciada en el 2008 fueran competitivas con las de Europa.
Se trata de una reforma de espectro liberal, en el que se busca optimizar la utilización
de los recursos por parte de la empresa y así maximizar los beneficios. La utilización de
los incentivos fiscales para la contratación, así como la reducción de los costes del
despido sin tener en cuenta la naturaleza del contrato quería favorecer el aumento de
la contratación sin que las empresas tuvieran que hacer frente a los altos costes de
mantener el empleo en el largo plazo. Con este cambio en la legislación laboral, se dota
de fuerza en el poder de negociación a las empresas, esto se realiza a través de los
cambios en la negociación laboral, de hecho, con esta reforma el efecto que se produce
es una disminución en el tiempo del poder adquisitivo de los trabajadores a causa de
los ajustes que se realizaron. El resultado se ha acabado viendo con el tiempo, y es que
como todo ciclo económico, el empleo se recuperó tras una grave crisis económica y
que todavía mantiene señales de que no fue una recuperación plena, sino que más bien
lo que produjo fue una falsa sensación de recuperación en todos los niveles y que, en
el momento en el que la Covid-19 golpeó la zona de Europa y en especial España, se
vio como la estructura económica no solo era débil sino que llevo a la economía a niveles
nunca vistos durante las últimas décadas. [-]

The Labour Reform of 2012, ‘Law 3/2012, of July 6, on urgent measures for the
reform of the labour market’ (‘Ley 3/2012, de 6 de julio, de medidas urgentes para la
reforma del mercado laboral’), marked a turning point in the legal framework of the
Spanish labour market. The measures adopted at such a critical economic moment
completely changed the situation of workers and the labour market itself. In the worst
moment of the economy in recent decades, workers saw how their rights were modified
and reduced in favour of an improvement in the competitiveness of companies. These
attained an even more dominant position with respect to the worker and it was only
valued that the companies that had survived the crisis that began in 2008 were
competitive with those of Europe. It is a reform in the liberal spectrum which seeks to
optimise the use of resources by the company and thus maximise profits. The use of tax
incentives for hiring, as well as the reduction of dismissal costs regardless of the nature
of the contract wanted to favour an increase in hiring without companies having to face
the high costs of maintaining employment in the long run. With this change in labour
legislation, companies are given bargaining power. This is done through changes in
labour negotiation. In fact, with this reform the consequence is a decrease in time of the
purchasing power of workers because of the adjustments that have been made. The
result has become visible over time and as in any economic cycle, employment
recovered after a serious economic crisis. This still shows signs that it was not a full
recovery, but rather produced a false sense of it at all levels. As Covid-19 hit Europe and
especially Spain, it became apparent that the economic structure was not only weak but
also how this phenomenon brought the economy down to levels never seen in the last
decades. [-]
