En el transcurso de una investigación ya sea policial o judicial, puede suceder que sea
necesario acceder al domicilio de las personas presuntas autoras de los hechos
delictivos, y, por ende, sea mermado el derecho fundamental de la inviolabilidad
domiciliaria de su titular contenido en el art. 18 de la Constitución Española. Para llevar
a cabo esta diligencia de entrada y registro, en los casos en los que no medie el
consentimiento del titular, la Ley de Enjuiciamiento Criminal contiene la regulación en
los artículos 545 a 572, estableciendo la obligación de que la autorización se realice por
el juez instructor mediante auto motivado, atendiendo siempre a los principios de
legalidad, necesidad, especialidad y proporcionalidad.
La diligencia de entrada y registro no puede adoptarse sin una identificación del presunto
autor de un hecho delictivo, por ello, será necesaria la correspondiente autorización
judicial, salvo en supuestos de flagrancia delictiva. Esto implica que la Policía Judicial
tendrá que informar de manera urgente mediante la correspondiente solicitud de la
necesidad de la autorización de esta diligencia al Juez que se encuentre de guardia en
aquel momento o al juzgado que venga conociendo de la causa.
Esta diligencia deberá realizarse siempre en presencia del Letrado de la Administración
de Justicia del Juzgado o Tribunal que hubiere autorizado el acto, o del Letrado de la
Administración de Justicia de guardia que le sustituya. También deberá estar presente
el interesado, salvo que no pueda o no quiera presenciar la práctica de la diligencia,
pudiendo nombrar un representante legítimo, y, en caso de no hacerlo, se seguirá el
régimen supletorio establecido en la propia LECRIM.
En cuanto a la intervención del letrado, la jurisprudencia del TS ha considerado que su
presencia en el desarrollo de la diligencia no es materialmente necesaria, salvo que el
titular del domicilio este detenido.
En la realización de la diligencia de entrada y registro puede ocurrir que se encuentren
pruebas relacionadas con un delito distinto al delito objeto de la diligencia, estos son los
denominados hallazgos casuales. Tras la reforma operada en la ley de enjuiciamiento
criminal por la Ley Orgánica 13/2015, de 5 de octubre, estos hallazgos casuales tienen
validez procesal siempre que hayan respetado los requisitos de la legalidad ordinaria
mediante la correspondiente autorización judicial siendo posible con posterioridad
proceder a la oportuna investigación criminal
Por último, cuando se realiza la diligencia de entrada y registro vulnerando el art. 18.2
de la CE, convirtiendo la prueba en ilícita, tal y como se desprende del art. 11.1 LOPJ.
Al respeto existen dos posiciones doctrinales, una, que sostiene que, dado el fin público
del proceso, se inclina a favor de la relevancia probatoria de la prueba ilícita, con
independencia de la forma lícita o ilícita en que fue obtenida. La otra, entiende que
después de su ilicitud se prive de eficacia probatoria de los medios de prueba así
obtenidos, pues es la sanción que conlleva el empleo de medios no permitidos, siendo
las normas relativas a las pruebas penales instrumentos de garantía para el imputado. [-]

In the course of a police or judicial investigation, it may be necessary to gain access to
the home of the alleged perpetrators of the criminal acts and, therefore, the fundamental
right to the inviolability of the home of the owner contained in Article 18 of the Spanish
Constitution may be undermined. In order to carry out this entry and registration
procedure, in cases where the consent of the owner is not obtained, the Law of Criminal
Procedure contains the regulations in Articles 545 to 572, establishing the obligation for
the authorization to be carried out by the investigating judge by means of a reasoned
order, always in accordance with the principles of legality, necessity, speciality and
proportionality.
The entry and search procedure cannot be adopted without an objective identification of
the presumed author of a criminal act. Therefore, the corresponding judicial authorization
will be necessary, except in cases of flagrante delicto. This implies that the Judicial Police
will have to urgently inform the judge on duty at that moment or the court hearing the
case, by means of the corresponding request, of the need to authorize this procedure.
This procedure must always be carried out in the presence of the Lawyer of the
Administration of Justice of the Court that has authorized the act, or the Lawyer of the
Administration of Justice on duty that replaces him/her. The interested party must also
be present, unless he/she cannot or does not wish to witness the performance of the
procedure, and may appoint a legitimate representative. If he/she does not do so, the
supplementary rules established in the LECRIM will be followed.
With regard to the intervention of the lawyer, the case law of the SC has considered that
his presence in the development of the diligence is not materially necessary, indicating
three cases in this respect. Firstly, when the owner of the home that is the object of the
proceedings is detained, the presence of his lawyer will be necessary for the consent
given by the detained person to be valid. Secondly, if the proprietor of the domicile grants
his consent for the entry and search of the domicile and is not detained, then the
procedure will be totally valid. And, thirdly, the presence of the lawyer is not required
during the entry and search of the home.
In the course of the entry and search procedure, it may happen that evidence is found
relating to a crime other than the crime which is the object of the procedure, these are
the so-called casual findings. These casual findings imply a breach of these
constitutional requirements, leading to uncertainty as to their legitimacy in the absence
of the corresponding judicial authorization. Currently, after the reform of the Organic Law
13/2015, of 5 October, these casual findings are valid as long as they respect the
ordinary legality of the proceedings in which the facts have been discovered, and,
subsequently, the corresponding criminal investigation is carried out.
A different case is that which arises when the entry and registration process is carried
out in violation of Article 18.2 of the EC, making the evidence illegal, as is clear from
Article 11.1 LOPJ. In this respect, there are two doctrinal positions. One, given the public
purpose of the process, favours the evidential relevance of the illegal evidence,
regardless of the legal or illegal way in which it was obtained. The other is that after its
unlawfulness the evidence thus obtained is deprived of evidential effectiveness, since it
is the sanction that entails the use of impermissible means, the rules of criminal evidence
being instruments of guarantee for the accused. [-]
