El artículo analiza y valora los contenidos de las recientes normas
promulgadas por el Estado y las Comunidades Autónomas con el fin de transponer la
«Directiva de servicios» en el sector del turismo. Las normas autonómicas han sustituido
casi totalmente los regímenes de autorización administrativa para el ejercicio de actividades
turísticas por sistemas de comunicación previa y declaración responsable, han
reforzado el papel monopolista de las agencias de viajes en la comercialización de
viajes combinados y han eliminado algunas obligaciones hasta ahora impuestas a los
prestadores de servicios turísticos (en materia de comunicación de precios a la autoridad).
No obstante, las normas autonómicas no son totalmente coherentes entre sí, y algunas se
apartan de las reglas liberalizadoras impuestas por la «Directiva de servicios» en materia
de guías de turismo, al amparo de las Directivas de profesiones reguladas. [-]

State and the Autonomous Communities in order to implement the so called «Directive on
services» in the tourism sector. These regulations have ... [+]
This paper analyzes and assesses the recent regulations enacted by the
State and the Autonomous Communities in order to implement the so called «Directive on
services» in the tourism sector. These regulations have mostly replaced the authorisation
regimes by other notification and declaration regimes; they have also strengthened the
monopoly of travel agencies in the field of package travels, and have eliminated several
obligations relying upon tourist operators (i.e., the compulsory communication of prices).
Nevertheless, these regulations are not totally coherent among them, and some of their
provisions do not comply with the «Directive on services» in the field of tourism guides,
under the pretext of the Directives on regulated professions. [-]
