La responsabilidad patrimonial de las Administraciones Públicas en Centros Penitenciarios

Abstract

En el presente trabajo se va a realizar un estudio de la responsabilidad patrimonial relacionada con la Administración Pública y sus actuaciones, así como las de sus trabajadores. En primer lugar se estudiará el concepto de Administración Pública y el de responsabilidad patrimonial, siendo ambos los ejes principales sobre los que versará el trabajo, junto al de Administración Penitenciaria. No obstante, este estudio se ha centrado a su vez en la responsabilidad patrimonial en la que se puede incurrir en el ámbito penitenciario. En el mismo, los internos se encuentran en una relación de sujeción especial con la Administración por lo que la misma debe garantizar sus derechos, ya que se le otorga la tutela de estos reclusos. Estudiaremos en qué casos la Administración incurre en responsabilidad patrimonial debido a su actuación normal o anormal, y los requisitos que se han ido determinando con el tiempo y que son necesarios para que esta responsabilidad se pueda dar. Así también se analizarán tres casos concretos dentro del ámbito penitenciario sobre los que se puede encontrar jurisprudencia muy diversa: el suicidio, la sobredosis por drogas y las lesiones. No obstante, no cabe olvidar la relación de sujeción especial que mantiene la Administración con sus trabajadores, analizando en este caso la de la misma con los funcionarios que trabajan en centros penitenciarios. Por último, se llevará a cabo un análisis de la responsabilidad patrimonial que encontramos regulada en las Leyes 39/2015 y 40/2015.

In the present work we are going to carry out a study of the patrimonial responsibility related to the Public Administration and its actions, as well as those of its workers. In the first place, the concept of Public Administration and that of patrimonial responsibility will be studied, being both the main axes on which the work will be based, together with that of Penitentiary Administration. However, this study has also focused on the liability that may be incurred in the penitentiary environment. In this study, inmates are in a special relationship with the Administration, and the Administration must guarantee their rights, since it grants them the protection of these inmates. We will study the cases in which the Administration incurs patrimonial responsibility due to its normal or abnormal actions, and the requirements that have been determined over time and that are necessary for this responsibility to occur. We will also analyse three specific cases within the penitentiary field on which very different jurisprudence can be found: suicide, drug overdose and injuries. However, we must not forget the special subjection relationship that the Administration maintains with its workers, in this case analyzing the same with the officials who work in penitentiary centres. Finally, an analysis will be carried out of the patrimonial responsibility that we find regulated in Laws 39/2015 and 40/2015.
