Ser madre y presa, la doble condena. El impacto en las madres y sus hijos del paso por la prisión

Abstract

El objeto de este trabajo es un estudio bibliográfico para determinar cuál es el impacto que provoca en las madres la estancia en prisión tras haber cometido un delito, y también cómo impacta este hecho en el menor, tanto si este convive con su madre entre rejas como si permanece fuera de la prisión. Para ello se establecerá en primer lugar el perfil general de las mujeres delincuentes. En segundo lugar, se explicará la normativa vigente en materia penitenciaria y seguidamente se explicarán los programas de reinserción que se imparten en nuestras cárceles españolas. En tercer lugar, se explicará cómo deberían actuar las FCSE y otras autoridades competentes ante la detención de la madre para reducir el impacto tanto en los menores como en sus madres. Finalmente, se establecerán las prácticas alternativas a la prisión cuando estas madres tienen hijos menores. Estas alternativas son de distintos países, incluida España. Se concluirá que no hay un punto de vista único para eliminar el impacto de los menores y sus madres, pero sí que es cierto que se ha determinado como se puede reducir este perjuicio.

The object of this paper is to conduct a bibliographic research the main objective of which is to determine the negative impact provoked by the imprisonment on mothers, after having committed a crime, and their children, whether they live inside the prison with their mothers or outside. Secondly, this project also aims to explain how the suitable procedure should be when a woman must be arrested by State Security Forces in Spain (FCSE) in order to reduce the negative impact that this may provoke on women and their children. Following, this project suggests alternative procedures to prison when the arrested women have children under their care. Some of these alternatives are inspired in the procedures already performed in other European and worldwide countries, including some examples from Spain, too. Finally, the conclusion offers an argumentation on the controversy of not existing a clear procedure to avoid negative impact on children and their mothers during the arrest of the mother. However, it is clear that some already determined procedures can reduce this damage that children and women may suffer.
