La mediación penal es uno de los métodos más importantes de la justicia restaurativa, aunque actualmente no se encuentre regulada de forma específica en materia de adultos. Es un modelo alternativo al derecho penal que se utiliza para resolver conflictos entre la víctima y el infractor. Este es supervisado por un tercero imparcial, fomenta el diálogo entre las partes y les ayuda a llegar a un acuerdo en que ambas salgan satisfechas.
El proceso se caracteriza por ser voluntario, confidencial, imparcial y rápido. No es un proceso costoso y su principal objetivo es reparar el daño tanto psicológico como material que la víctima ha sufrido a consecuencia de los hechos causados. Se puede iniciar en cualquier momento del proceso penal, ya sea en la fase de instrucción como en la de enjuiciamiento o en la de ejecución. En el momento que algunas de las partes no quieran continuar con la mediación, ésta llega a su fin y sigue el procedimiento normal.
Las ventajas que tiene la mediación penal es que permite recuperar el papel protagonista a la víctima, fomenta el dialogo para la resolución de conflictos, puede tener efectos preventivos y permite que el infractor se responsabilice de los hechos, repare el daño causado y comprenda los efectos de su conducta. Criminal mediation is one of the most important methods of restorative justice even though it is not currently regulated in terms of adults. It is an alternative model to the criminal law that is used to resolve conflicts between the victim and the offender. This is supervised by an impartial person that encourages dialogue that allow both parties to express themselves and help them to reach an agreement in which both parties are satisfied. The process is characterized by being voluntary, confidential, impartial and quick. It is not a hard process and its main objective is to repair the psychological and material damage that the victim has suffered as a result of criminal acts. It can be initiated at any time during the criminal process, even in the investigation phase or in the trial phase or in the execution phase. In the moment that some of the parties do not want to continue with the mediation.
The advantages of criminal mediation are that it allows the protagonist to recover the victim's role, encourages dialogue for the resolution of conflicts, can have preventive effects and allows the offender to take responsibility for the facts, repair the damage caused and understand the effects of his behaviour.
