Análisis de los criterios de valoración de la peligrosidad criminal en la suspensión de la condena

Abstract

The general objective of this work is to carry out a legal - penal and criminological study on the action of the suspension of the sentence and the modifications which affect it from the 2015 reformation. Concretely, we have taken into account the evaluative criteria of the criminal dangerousness of the Spanish legal system on a large scale, and these h ave been developed to check if the criteria used are correct. For this task, I will begin by carrying out a study of the concept of criminal dangerousness and the historical evolution that both its nomenclature and definition have suffered. Next, I have s tudied the evolution of the criteria for evaluating criminal dangerousness by the different penal codes , with the purpose of observing the expired evaluation methods, and also see the reasons for their change, as well as to appreciate the advantages offere d by the new 2015 regulation, and compare them to the previous ones. Finally, I have done an analysis of the evaluation criteria of the criminal dangerousness found in the 2015 regulation and a study of the crimino l ogical report , as it is the essential too l which criminologists use in order to develop their profession, as well as the instrument through which they expose their studies, considerations and conclusions.

El trabajo realizado tiene por objetivo general la realización de un estudio jurídico penal y criminológico acerca del fenómeno de la suspensión de la pena y de las modificaciones que le afectan a partir de la reforma penal de 2015 , concretamente hemos tenido en consideración los criterios de valoración de la peligrosidad criminal del ordenamiento jurídico español a gran escala y estos se han desarrollado para ver finalmente si los criterios utilizados son los correctos . Para ello, se comenzará por realizar un estudio d el concept o de peligrosidad criminal y observar que evolución histórica ha sufrido tanto su definición como su nomenclatura. Seguidamente, hemos estudiado los criterios de evaluación de la peligrosidad criminal por los distintos códigos penales, con la finalidad de observar los métod os de evaluación expirados, ver el motivo de su cambio y apreciar las ventajas que nos ofrece la nueva regulación de 2015 en comparación con las anteriores. En último lugar, se ha realizado un análisis de los criterios de evaluación de la peligrosidad crim inal que enc ontramos en la nueva regulación y un es tudio del informe criminológico, instrumento básico de los criminólogos que utilizan para poder desarrollar su profesión, mediante el cual exponen sus estudios, consideraciones y conclusiones
