La protección del medio ambiente en los planes de emergencia de Protección Civil

Abstract

Disasters and environmental catastrophes produce serious consequences on the population, such as deaths, injured or just disappeared, but there is also environmental damage, such as soil and water contamination, destruction of flora and fauna, etc. The Spanish national civil defence system operates firstly in order to ensuring citizen safety in front of all kinds of emergencies, but are not the only element involved, it must not be forgotten the protection of the environment, as this is also seriously affected, as stated in the preamble of the National System of Civil Protection Law. Therefore, the main objective of this research was based on the analysis of the role of the civil protection on the preservation of environment from disasters, their inclusion in national legislation and his practice implementation. In order to that, we analyse some of different plans and laws involved in this area, trying to approach the difficulties in practice and to generate proposals to achieve a more effective public administration performance. The analysis concludes that there is a significant gap in Spanish legislation relative to la the post-emergency phases to environmental recovery and this demonstrates the need for introduce measures to ensure the effectiveness of this phase, such as a minimum regulation of its content.

Las catástrofes y emergencias ambientales producen graves trastornos en la población, tal como muertes, heridos o desaparecidos, pero también en el medio ambiente, como la contaminación del suelo y el agua, la destrucción de la flora y la fauna, etc. El sistema de protección civil español actúa, en primera instancia, para asegurar la seguridad ciudadana frente todo tipo de emergencias, pero no debe olvidarse la función de protección del medio ambiente, pues este también se ve gravemente afectado, tal como se expone en el preámbulo de la Ley 17/2015 del Sistema Nacional de Protección Civil. Por ello, el objetivo principal de esta investigación se basa en el análisis del papel de la protección civil española en la conservación del medio ambiente frente a las catástrofes, su inclusión en la legislación y su puesta en práctica. Para ello se analizan algunos de los diferentes planes y leyes existentes en la materia, intentando realizar un acercamiento a las dificultades existentes en la práctica y a generar propuestas para lograr una actuación más eficaz por parte de las administraciones. El análisis concluye que existe un vacío importante en la legislación española en relación a la fase post-emergencia de recuperación del medio ambiente y se hace patente la necesidad de introducir medidas para dotarla de más eficacia, así como una mínima regulación del contenido de dicha fase.
