El desarrollo de la libertad religiosa y la relación con las confesiones religiosas
en el marco de distribución de competencias de la CE de 1978 ha sido poco
estudiado. Este trabajo atiende a tres puntos: en primer lugar analizar los arts. 148 y
149 CE para determinar si el constituyente preveía algo al respecto. En segundo lugar
identificar los límites sustanciales y competenciales que existen al desarrollo autonómico
de la libertad religiosa y de relación con las confesiones religiosas y, por último,
examinar la STC 207/2013, de 5 de diciembre, que anula una norma de la Comunidad
Foral de Navarra por vulnerar el modelo básico de laicidad español. Se concluye
afirmando que en un sentido propio no pueden existir modelos autonómicos de laicidad
distintos al estatal, aunque sí son constitucionalmente legítimas modulaciones
entre las distintas comunidades autónomas. [-]

The development of religious freedom and the relation with religious
groups within the framework of the devolution of powers in the Spanish Constitution
has not been studied much. This study focuses on three areas: firstly, it analyzes art.
148 and 149 of the Spanish Constitution in order to determine if the constitutional
legislator foresaw something in this regard. Secondly, it seeks to identify the substantial
and jurisdictional limits to the autonomous development of religious freedom
and respect of religious confessions and, finally, to examine sentence 207/2013 dated
December 5 of the Spanish Constitutional Court, which annuls a law of the Navarre
Region for violating the basic model of Spanish Church-State relations. The research
concludes by affirming that, in the strict sense, there cannot be two regional models
regulating Church-State relations distinct from the state model, even though there
exist constitutionally legitimate variations in the different regions. [-]
