Between cherry-picking and salvaging the Titanic: Spain and the rescuing of the essence of the EU Constitution

Abstract

Within the context of the prevailing situation that came about as a result of the rejection of the EU constitutional treaty in 2005 and the subsequent inefficient reflection period, Spain has been faced with several options and scenarios. Each presents risks and opportunities in terms of contributing to the rescue of the original text, its possible transformation, or its termination. In any event, it appeared that the Spanish leadership wanted to make the point that if “Europe is the problem, Spain is the solution”, rewriting Ortega’s historical assessment (Ortega, Obras). This paper first analyzes the options, scenarios and possible outcomes, with a special emphasis on the activities led by the new Spanish government elected in 2004.

Dentro del contexto que se produjo como consecuencia del rechazo del tratado constitucional de la UE en 2005 y el período de reflexión posterior, ineficiente España se ha enfrentado a varias opciones y escenarios. Cada uno presenta riesgos y oportunidades en términos de contribuir al rescate del texto original, su posible transformación, o su terminación. En cualquier caso, parece que el liderazgo español quiso dejar claro que si "Europa es el problema, España es la solución", la reescritura de la evaluación histórica de Ortega (Ortega, Obras). En este trabajo se analiza primero las opciones, escenarios y posibles resultados, con un énfasis especial en las actividades dirigidas por el nuevo gobierno español elegido en 2004.
