El objetivo del presente trabajo es analizar la figura del testigo en el proceso penal. Concretamente se va a hacer referencia a su declaración durante el proceso penal.
Para conseguir este objetivo, comenzaremos por analizar al testigo partiendo de su concepto más amplio (al margen del proceso penal). Acto seguido, repararemos en ciertos aspectos psicológicos del mismo. En primer lugar se hará referencia a la competencia del testigo en general, para lo cual veremos qué capacidades básicas ha de reunir. Dentro de estas capacidades se hará especial mención a la capacidad de memoria y por último, veremos qué factores pueden afectar a la exactitud de su testimonio.
Para seguir con el análisis psicológico del testigo, nos centramos en dos figuras concretas: el testigo menor de edad y la víctima-testigo. En referencia al primero, repasaremos algunas generalidades en cuanto a su capacidad de memoria así como ciertas problemáticas que puede presentar su testimonio, para acabar exponiendo en qué consiste el Análisis de Validez de las Declaraciones (una herramienta muy usual en nuestro país para analizar la declaración de los menores). En cuanto a la víctima testigo, comenzamos con la definición del concepto “víctima”, para continuar definiendo qué son los procesos de victimización y qué efectos pueden tener en la persona y, por extensión, en el proceso. Para finalizar se hace una breve referencia al debate existente sobre el Trastorno de Estrés Post-Traumático (TEPT) y sus efectos sobre la memoria.
Una vez hemos repasado la definición de testigo así como los aspectos psicológicos que lo rodean, pasamos a encuadrarlo dentro del proceso penal. Para ello se ha optado por separar de una parte, la declaración del testigo durante la fase de investigación, y de otra, la declaración testifical como prueba en el juicio oral. Aquí veremos quienes pueden aportar información al proceso en cada fase y cómo lo hacen. Otra cuestión de suma importancia es la de cuándo la declaración testifical adquiere auténtico valor probatorio. Para ello, analizamos también bajo qué circunstancias, puede la prueba testifical como medio de investigación, adquirir ese valor.
Para acabar, la última parte del presente trabajo pretende responder a la pregunta: ¿cómo se valora la prueba testifical?
Para ello, hemos comenzado por la figura simple del testigo directo o presencial y hemos visto qué se tiene en cuenta por los Jueces o Tribunales (credibilidad y fiabilidad).
A continuación, para mostrar la importancia que puede alcanzar la prueba de testigos, hemos recalcado bajo qué circunstancias, puede la prueba testifical desvirtuar la presunción de inocencia. En primer lugar, desde la figura del testigo directo y más adelante, exponiendo cómo se valora la prueba testifical en determinados supuestos que pueden resultar problemáticos: el testigo de referencia, el testigo anónimo, el testigo menor de edad o incapaz y por último la víctima testigo. There are many ways to investigate crime. Spanish law contains different types of procedures that let us obtain the necessary evidence in a legal form. These procedures extend their effects through the whole process, from the pertinent complaint to the final judgment.
As you see, in order to find the evidence, law enforcement must play by the rules. Rules that mean respecting a list of values that tend to guarantee the rights of the both parts in the process in order to hold a fairer trial.
In this way, when someone does not respect this guarantee while obtaining the necessary evidence, the result is that the said evidence doesn’t provide the necessary value, and the legal system doesn’t take them into account.
To investigate some kinds of crimes, law enforcement can, when the circumstances allow, draw on the witness statement. This method of investigation, basically consists in obtaining the relevant information that someone might have which is related with a crime or with the circumstances that surround the criminal fact that can take us closer to the truth.
The Spanish legal system says that, as a general rule, the person who has certain knowledge of a criminal fact, has the duty of making a statement to the relevant court. There are some exceptions to this rule which affect people with professional secrets and people that are related to the alleged offender, etc.
One of those exceptions includes, according to the article 417.3º “Ley de Enjuiciamiento Criminal” (LECrim), physical disabled people (when their disability makes it impossible to take a true statement) and mentally disabled people. In my lowly opinion, this is an abstract term that does not settle a defining basis.
To examine the capacity of witnesses, we must start by defining what is a witness. The RAE Dictionary definition is that “a witness is a person that acquires true and direct knowledge about a fact”. In the Spanish legal system, a witness is the person that, as we suspect, knows something legally outstanding such as criminal facts or the circumstances that involve the criminal fact.
The person who offers their statement to the court must be a person able to communicate true facts. This is a very important point if we take into account that the witness statement is able, under certain circumstances, to detract the presumption of innocence of the alleged offender. [-]
