Drets humans i democràcia

Abstract

La Conferència Mundial dels Drets Humans celebrada a Viena el 1993 defineix clarament quina és la relació entre democràcia i drets humans: «són interdependents i es reforcen recíprocament». L’objectiu d’aquest article és aprofundir en el sentit d’aquesta afirmació per explicitar el potencial de racionalitat que els drets humans contenen. La tesi que vol demostrar l’autor, basant-se principalment en l’obra de Habermas Faktizität und Geltung és que aquesta interdependència entre drets humans i democràcia configura un procés dinàmic que, a l’hora que comporta una reinterpretació constant dels drets humans, condueix el procés democràtic en una determinada direcció.

The World Conference on Human Rights celebrated in Vienna in 1993 clearly defines the relationship between democracy and Human Rights: «They are interdependent and reinforce one another». The aim of this article is to take a closer look at the meaning of this affirmation in order to identify the potential for rationality contained in Human Rights. The thesis that the author sets about demonstrating is largely based on Habermas’ work Faktizität und Geltung, finding that this interdependency between Human Rights and democracy configures a dynamic process which, while implying a constant reinterpretation of Human Rights, leads the democratic process along in a certain direction.
