El Tribunal Supremo reconoce, en este recurso de casación para la unificación de doctrina, que es procedente el despido que la empresa entrante lleva a cabo en la persona del trabajador que acaba de ser subrogado cumpliendo lo previsto en el convenio colectivo. La razón es que el trabajador carece de la titulación exigida en el pliego de condiciones de la contrata, aunque se acredita una experiencia de cinco años en el puesto con la empresa saliente. [-]
