Delitos de odio: la islamofobia a consecuencia del terrorismo

Abstract

El presente trabajo de fin de grado tiene como finalidad realizar una aproximación teórica de los delitos de odio, en especial a su regulación penal, cuáles son las conductas típicas de estos y su cabida legal tanto nacional como internacionalmente así como la perspectiva criminológica de estos, todo en relación al terrorismo y su incidencia con la islamofobia; entendiendo como islamofobia todo acto discriminatorio hacia una persona o grupo de personas por razón de su religión. En cuanto a esta, se pretende realizar un estudio para comprobar si el terrorismo ha tenido incidencia y es una de las causas de la islamofobia. Para ello se evalúan los resultados obtenidos mediante un formulario con una muestra de 256 participantes de diversas edades, género, creencias religiosas y lugar de residencia. Se llevó a cabo un estudio cualitativo y cuantitativo comparando intergrupos mediante la prueba de Kruskal – Wallis, en cuyos resultados se observó una tendencia indicando haber percibido e incluso recibido mayor odio tras los ataques terroristas de naturaleza integrista que ha sufrido la población. Se concluye así que, el terrorismo en un grave delito cuyas consecuencias son muy diversas, entre ellas el odio generado hacia los musulmanes tras los sucesivos ataques terroristas habidos en los últimos años

The aim of this final degree project is to carry out a theoretical approach to hate crimes, especially their criminal regulation, what are the typical behaviours of these crimes and their legal scope both nationally and internationally, as well as the criminological perspective of these crimes, all in relation to terrorism and its impact on Islamophobia; Islamophobia being understood as any discriminatory act towards a person or group of people because of their religion. With regard to the latter, the aim is to carry out a study to check whether terrorism has had an impact and is one of the causes of Islamophobia. To this end, the results obtained are evaluated by means of a form with a sample of 256 participants of different ages, gender, religious beliefs and place of residence. A qualitative and quantitative study was carried out, comparing inter-groups using the Kruskal-Wallis test. The results showed a tendency to perceive and even receive greater hatred after the terrorist attacks of a fundamentalist nature suffered by the population. The conclusion is that terrorism is a serious crime with a wide range of consequences, including the hate generated towards Muslims in the wake of successive terrorist attacks in recent years.
