Del enriquecimiento ilícito a la desobediencia por enriquecimiento injustificado de autoridades

Abstract

El presente trabajo tiene como objeto analizar la nueva regulación del delito de desobediencia por enriquecimiento injustificado de autoridades recogido en el artículo 438 bis del CP español. Estudia las propuestas de penalización del delito de “enriquecimiento ilícito” y las razones que han motivado que se configure como una desobediencia. Por último, se estudia la estructura del delito.

The article analyzes the new regulation, in art. 438 bis PC, of the crime of disobedience related to unjust enrichment of authorities. Studies the proposals to criminalize the crime of “illicit enrichment” and the reasons that motivated the configuration as a disobedience. Lastly, the article studies the structure of the crime.
