La suspensión de un traslado a un nacional de un tercer país víctima de trata de seres humanos hasta la finalización del período de reflexión: un avance necesario pero limitado en la protección de estas víctimas

Abstract

El 22 de octubre de 2022, el Tribunal de Justicia de la Unión Europea (TJUE) en el asunto Staatssecretaris van Justitie en Veiligheid, dictó sentencia sobre el art. 6 de la Directiva 2004/81/CE relativa al permiso de residencia expedido a nacionales de terceros países que sean víctimas de trata de seres humanos o que hayan sido objeto de una acción de ayuda a la inmigración ilegal que cooperen con las autoridades competentes. El TJUE clarificó que la protección de las víctimas de la trata de seres humanos constituye una prioridad. El traslado de un nacional de un tercer país al Estado responsable para examinar su solicitud de protección internacional debe suspenderse hasta que finalice el período de reflexión concedido por la Directiva 2004/81 y se haya otorgado al nacional de un tercer país la oportunidad de librarse de la influencia de los autores de los delitos y decidir si colaborar con las autoridades policiales y judiciales nacionales en las investigaciones.

On 22 October 2022, the Court of Justice of the European Union (CJEU) in the case Staatssecretaris van Justitie en Veiligheid, delivered a judgment on Article 6 of Directive 2004/81/EC on the residence permit issued to third-country nationals who are victims of trafficking in human beings or who have been the subject of an action to facilitate illegal immigration, who cooperate with the competent authorities. The CJEU made it clear that protecting victims of human trafficking constitutes a priority. The transfer of a third country national to the State responsible to examine their application for international protection must be suspended until the reflection period granted by Directive 2004/81 is completed and the third country national has been given the occasion to escape from perpetrators and decide whether to collaborate with national law enforcement and judicial authorities in investigations.
