Las migraciones forzadas inducidas por el cambio climático: retos conceptuales y perspectivas de protección

Abstract

El presente trabajo busca analizar un tema que está ganando espacio en el ámbito internacional: las migraciones forzadas inducidas por el cambio climático. Así, tratando de identificar las características de este tipo de categoría migratoria y los instrumentos que actualmente el Derecho Internacional proporciona para tutelar estas personas, se busca identificar: el nexo causal entre la migración y el cambio climático, así como las dificultades en el momento de conceptuar y proteger este grupo migratorio por medio del Estatuto de los Refugiados. Igualmente, se pretende analizar cómo los flujos y las políticas migratorias contemporáneas, que criminalizan y detienen ilegalmente a las personas migrantes, creando barreras no sólo físicas sino también mentales a la llegada del extranjero en el país de destino, dificultan la acogida y protección de los migrantes climáticos. Finalmente, se concluye que una respuesta internacional adecuada requiere, por un lado, el reconocimiento del estatus de refugiado para esta nueva categoría y, por otro, la construcción de estrategias jurídicas y sociales, basadas en los cuidados y la responsabilidad intergeneracional con el futuro del planeta y sus habitantes, para hacer frente a los múltiples factores que obligan al ser humano a desplazarse por razones climáticas.

This research work aims to analyze a topic that is gaining awareness in the international environment: the forced migration fluxes caused by climate change. Therefore, in trying to identify the main factors of this new migrant category and what kind of procedure the International Law utilizes to bring sanctuary to these people, the main focus has been posed on: the link between migration and climate change and the difficulties to identify and bring sanctuary to this new migrant group using the «International Refugee Law». Moreover, the research work focuses on how the migrant fluxes and the migrant contemporary policies make it possible to criminalize and illegally arrest migrants by creating not only physical walls but social ones as well, turning the integration process into a real struggle. Finally, the research, suggests that an international answer to this problem needs the recognition of this new refugee category and, the building of new strategies, both in the legal and social areas, based on the intergenerational responsibility for the future of the planet and its inhabitants, to have an adequate response to the multiple factors which force peoples worldwide to move due to the climate change.
