Aproximación al experto en reestructuraciones en el Proyecto de Ley de reforma del Texto refundido de la Ley Concursal

Abstract

El presente trabajo se ocupa de la figura del experto en reestructuraciones. Así, y partiendo de la regulación que ofrece la directiva (UE) 2019/1023, se procede en segundo lugar a analizar cómo ha quedado configurado el experto en el Proyecto de Ley de reforma del texto refundido de la Ley concursal, actualmente en fase de tramitación parlamentaria. El trabajo aspira a ofrecer una primera aproximación a este nuevo actor, resaltando sus luces y sus sombras y valorando en qué medida la decisión del legislador español se ha revelado acertada o no.

The present paper focuses on the role of the restructuring expert and thus, starting with its regulation as contained in the EU Directive 2019/1023, in a second moment the paper analyses how this regulation has been incorporated into Spanish law, namely in the Draft Act modifying the Insolvency Act which is now undergoing the elaboration phase in Parliament. The article aims at offering a first glimpse of this new player, pointing its lights and shadows and assessing whether the decision of the Spanish legislator has proven right or not.
