El bienestar animal es un valor en sí mismo que debe asegurarse a los animales
como seres sintientes, lo cual obliga a reconocerles como agentes morales. Ello implica asumir
que su tutela jurídica tiene una legitimidad autónoma y que, por ende, los estudios de derecho
animal son una rama del ordenamiento cargada de futuro. En el futuro inmediato hay algunas
reformas urgentes para el derecho español desde una triple perspectiva: como exigencia moral,
como condición de subsistencia de nuestros propios ecosistemas y como exigencia de integración
en la UE al resultar inaplazable la caracterización de los animales como seres “sensibles” del
artículo 13 del Tratado de Funcionamiento de la Unión Europea (TFUE); en especial en los
sectores del ordenamiento jurídico que no están directamente regulados por el derecho de la Unión
Europea: el derecho penal, el civil y el mercantil. Se trata, pues, de conseguir la definitiva
descosificación de los animales, excluyéndolos del grupo de bienes de los que su titular puede
disfrutar, usar y abusar. De igual modo hay que limitar las tradiciones bárbaras, la explotación
institucionalizada y la investigación abusiva, que son, hoy por hoy, las verdaderas fronteras del
bienestar animal. [-]

Animal welfare is a value in itself that should be ensured for all animals as sentient
beings, which forces us to recognize them as moral agents. This leads to the assumption that their
legal protection has an autonomous legitimacy and that, therefore, the study of animal law as a
branch of the legal system can only continue growing towards the future. In the immediate future,
some urgent reforms of the Spanish legal system are due from a a triple perspective: as a moral
requirement, as a condition for the subsistence of our own ecosystem, and as a need to address
and integrate within EU regulations. The assimilation of the characterization of animals as “sentient”
beings, as established in article 13 of the Treaty on the Functioning of the European Union (TFUE),
cannot be postponed, especially in sectors of the legal system that are not directly affected by
European Union law: criminal, civil and commercial law. Ultimately what is at stake is the definitive
de-objectification of animals and their exclusion as a category of goods that may be enjoyed, used
and abused by the owner. In the same way, barbaric traditions, institutionalized exploitation and
abusive research, which are, today, the true frontiers of animal welfare, should be subjected to legal
limits. [-]
