Herramientas para el abordaje jurisdiccional de las violencias por razones de género

Abstract

El objetivo de este trabajo es compartir experiencias de abordajes jurisdiccionales desde la perspectiva de género feminista de Argentina, a través de sentencias que amplían y reconocen el derecho humano de las mujeres a vivir una vida libre de violencias. Para ello, se desarrolla el marco normativo, las categorías clave provistas por la teoría feminista que dan contenido a la legislación, como también los últimos datos disponibles sobre violencias por razones de género en Argentina. Bajo el entendimiento de que las sentencias tienen efecto mucho más allá de las personas que son parte en la causa, se observa que los mensajes que emite el poder judicial transcienden «el caso» para construir sentidos sociales sobre los temas que son objeto de tratamiento, en esta oportunidad, los derechos humanos de las mujeres. En este sentido, metodológicamente es necesario aclarar que las sentencias que se presentan en el apartado de abordaje jurisdiccional fueron seleccionadas interesadamente a partir de la intención de mostrar cómo el poder judicial puede -y de hecho lo hace- introducir la perspectiva de género feminista en sus resoluciones. Junto con Smart (2000) se reafirma que el Derecho tiene género, y puede constituirse en un discurso emancipatorio que sedimente sociedades más justas.

The objective of this work is to share experiences of jurisdictional approaches from the feminist gender perspective of Argentina, through sentences that expand and recognize the human right of women to live a life free of violence. For this, the normative framework is developed, along with the key categories provided by feminist theory that give content to the legislation, as well as the latest data available on gender-based violence in Argentina. Under the understanding that the sentences have an effect far beyond the people who are parties to the case, it is observed that the messages issued by the judiciary transcend «the case» to build social meanings on the issues that are subject to treatment, in this case, the human rights of women. In this sense, methodologically it is necessary to clarify that the judgments presented in the section on jurisdictional approach were interestingly selected based on the intention of showing how the judiciary can -and in fact does- introduce the feminist gender perspective in its resolutions. Along with Smart (2000), it is reaffirmed that Law has gender, and can become an emancipatory discourse that sediments fairer societies.
