El Delator en el Sistema de Justicia Penal Español

Abstract

El objetivo de este Trabajo Final de Grado es analizar la figura del delator en el ordenamiento jurídico-penal español. El delator como informante en el procedimiento penal, precisa su deslinde conceptual de otros meros testigos, del confidente policial, del arrepentido, del infiltrado, del informante y del colaborador. Debido a la falta de regulación objetiva en España, habrá que acudir a su delimitación jurisprudencial, así como al Derecho Comparado y a otra normativa y textos internacionales, como es la Directiva (UE) 2019/1937 del Parlamento Europeo y del Consejo, de 23 de octubre de 2019, relativa a la protección de las personas que informen sobre infracciones del Derecho de la Unión. El empleo del delator es de interés estratégico para lograr el enjuiciamiento y condena en ilícitos que constituyen los atentados más graves a los bienes jurídicos colectivos, como es el caso del terrorismo, delincuencia organizada, corrupción, delitos contra la salud pública y delitos perpetrados en el seno de personas jurídicas de gran envergadura. Sin embargo, el uso del delator y figuras afines ha de respetar en todo caso el sistema de derechos fundamentales y garantías que parte de la Constitución Española. Por último, resulta de interés la cuestión de la deficiente protección del delator en causas criminales.

The objective of this Final Degree Project is to analyze the figure of the whistleblower in the Spanish legal-criminal system. The informer as an informant in the criminal procedure, specifies his conceptual demarcation from other mere witnesses, the police confidant, the repentant, the infiltrator, the informant and the collaborator. Due to the lack of objective regulation in Spain, it will be necessary to resort to its jurisprudential delimitation, as well as Comparative Law and other international regulations and texts such as Directive (EU) 2019/1937 of the European Parliament and of the Council, of 23 October 2019, on the protection of people who report infringements of Union law. The use of the informer is of strategic interest to achieve the prosecution and conviction of crimes that constitute the most serious attacks on collective legal assets, such as terrorism, organized crime, corruption, crimes against public health and crimes perpetrated in the within large legal entities. However, the use of the informer and related figures must in any case respect the system of fundamental rights and guarantees that is part of the Spanish Constitution. Finally, the issue of deficient protection of the whistleblower in criminal cases is of interest.
