El interés del menor investigado y del menor víctima en el proceso de menores

Abstract

La infancia es una fase innata de todo ser humano. Podemos entonces decir que esta será importante para todo individuo por haber sido parte de su historia y por tener ciertas vivencias que ya no experimentan de adultos. Sin embargo, dentro de estas vivencias ocurrirá que la vida no siempre haya tratado bien a cierto menor y acabe siendo víctima de un delito por parte de sus padres, de sus compañeros de clase o de un extraño, o por lo contrario, acabar siendo investigado por un comportamiento que acaba en disputa en los tribunales de menores. Es común escuchar casos en los que se ven involucrados menores y es por esto que la sociedad a día de hoy se escandaliza o critica pero, ¿hasta qué punto la sociedad con la que convive el menor lo valora correctamente?, ¿respeta realmente lo que es ser un niño?, ¿debería dejarle cometer errores sin represaría alguna sin atender a la gravedad de sus actos? Conocemos entonces la infancia por ser un episodio de nuestras vidas pero no conocemos la realidad de los niños y ocurre que existen discrepancias de opiniones alrededor de los casos de menores que quebrantan la ley, mientras que para las menores víctimas es una postura suavizada, cuando ambos son menores de edad. Por ello, este trabajo tiene por objeto explicar lo que es ser un niño, la importancia y el interés que se le da a la infancia en la realidad actual y como responde la justicia y la sociedad ante los casos en los que se ven involucrados los niños, sea cual sea la postura en la que acaben.

Childhood is an innate phase of every human being. We can then say that this will be important to every individual because they have been part of their history and have certain experiences they no longer experience as adults. Nevertheless, inside these experiences it will happen that the life not always has treated well certain minor and ends up by being a victim of a crime on the part of its parents, its schoolmates or a stranger, or for the opposite, to end up by being investigated by a behaviour that finishes in dispute in the minors' courts. It is common to listen to cases in which involved minors meet and that's why the society to today is scandalized or criticizes but: until point the society with whom the minor lives together values it correctly?: does he respect really what is to be a child?: should it allow him to commit errors without reprisal anyone without attending on the gravity of its acts? We know children as an episode of our lives, but we do not know the reality of children and there are differences of opinion around cases of minors who break the law, whereas for the minors victims it is a relaxed stance, when both are minors. For it, this work takes as an object to explain what is to be a child, the importance and the interest that is given to the infancy in the current reality and as the justice and the society answers before the cases in which the children turn out to be involved, be which be the position in which they finish.
