El Derecho Penal ante la violencia de género: evolución y eficacia

Abstract

En el siguiente Trabajo de Fin de Grado abordaremos la evolución legislativa de la regulación punitiva en materia de violencia de género. Trataremos los diferentes problemas que han ido surgiendo tras la entrada en vigor de la LO 1/2004, de 28 de diciembre, de Medidas de Protección Integral contra la Violencia de Género, analizando de manera crítica las modificaciones correspondientes a cada artículo en relación con el ámbito de la violencia de género. En segundo lugar, se realizará un análisis estadístico en materia preventiva, en relación con el apartado anterior, para ver hasta qué punto son efectivas las modificaciones que ha introducido el legislador en nuestro Código Penal. Se pretende, por tanto, mostrar la efectividad de la regulación punitiva en materia de violencia de género tras la promulgación de la Ley, así como incidir en la opinión sobre las críticas doctrinales acaecidas durante este tiempo y, sobre todo, el resultado final de esta Ley sobre las personas a las que se protege, es decir, a las mujeres maltratadas a manos de sus parejas o exparejas. Con todo ello, a través de dicho trabajo, se aspira, por consiguiente, a conocer y destacar los puntos débiles y puntos fuertes de la Ley de Violencia de Género.

In the following Final Degree Project we will address the legislative evolution of the punitive regulation of gender violence. We will deal with the different problems that have arisen after the entry into force of the LO 1/2004, of December 28, on Comprehensive Protection Measures against Gender Violence, critically analyzing the amendments corresponding to each article in relation to the field of gender violence. Secondly, a statistical analysis will be carried out on preventive matters, in relation to the previous section, to see to what extent the modifications introduced by the legislator in our Penal Code are effective. The aim, therefore, is to show the effectiveness of the punitive regulation on gender violence after the enactment of the Law, as well as to influence the opinion on the doctrinal criticisms that have occurred during this time and, above all, the final result of this Law on the people it protects, that is, women abused at the hands of their partners or ex-partners. With all this, through this work, we aim, therefore, to know and highlight the weaknesses and strengths of the Law on Gender Violence.
