Justicia Restaurativa en el ámbito juvenil: aplicación y perspectiva de futuro

Abstract

El propósito que persigue el presente trabajo es estudiar la estructura que establece la Ley Orgánica 5/2000, de 12 de enero, reguladora de la responsabilidad penal de menores, y cómo se ha introducido la justicia restaurativa en el proceso penal de menores. Para ello, será necesario entender los antecedentes y su evolución hasta la regulación actual, así como los principios informadores que rigen el funcionamiento de la jurisdicción. Por otra parte, se introduce el origen de la justicia restaurativa en un contexto genérico, tras el que se explicará su situación actual en el ordenamiento jurídico español, y su aplicación en menores infractores a través del principio de oportunidad. Para entender la propuesta, en contraposición al modelo retributivo que ha seguido tradicionalmente el Derecho Penal, se desarrollan los pilares fundamentales en los que se basa, sobre los que se comentará los pros y contras. Por último, se hará mención a la mediación penal con menores, siendo esta la práctica restaurativa más extendida, y los programas que han desarrollado, por el momento, algunas Comunidades Autónomas. En síntesis, se extraerá, por una parte el perfil del menor que finaliza satisfactoriamente la mediación, y por otra el de los reincidentes.

The purpose of this work is to study the structure established by the Organic Law 5/2000, of January 12, regulatory of criminal liability of minors, and how restorative justice has been introduced in the criminal proceedings. For this, it will be necessary to understand the background and its evolution to the current regulation, as well as the reporting principles that govern the functioning of the jurisdiction. On the other hand, the origin of restorative justice is introduced into a generic context, after which its current situation will be explained in the Spanish legal system, and its application 7 in minors offenders through the principle of opportunity. To understand the proposal, as opposed to the retributive model that has traditionally followed criminal law, the fundamental pillars are developed on which it is based on, on which the pros and cons will discuss. Finally, mention will be made to criminal mediation with minors, this being the most widespread restorative practice, and the programs that have been developed, for the time being, some autonomous communities. In short, the profile of the minor that successfully completes mediation, and by another one of the repeatures will be extracted, on the one hand.
