La Unión Europea constituye una firme defensora de la necesidad de
ahondar en el despliegue de la Administración electrónica y la Directiva de Servicios
representa en este sentido uno de sus hitos más destacados. En la Directiva hallamos un
conjunto de mandatos dirigidos a los Estados a fin de que obren una profunda conversión
electrónica del entorno burocrático que rodea a la intervención administrativa sobre
las actividades de servicios. Todos los trámites y procedimientos deberán transformarse
a fin de que su evacuación pueda realizarse telemáticamente. Además, para atajar el
grave problema de la fusión de autorizaciones, se exige crear una ventanilla única de
servicios desde la que poder obtener información y sustanciar a distancia los distintos
pasos burocráticos; una ventanilla que, lógicamente, también ha acabado por tener una
veste electrónica. Se trata, pues, de mandatos de mucho fuste cuyo cumplimiento requiere
de los Estados un esfuerzo extraordinario en el que, más allá del liderazgo activo de
una Administración, hace falta un interesamiento y una convergencia meditada de todas
las Administraciones involucradas. Es aquí donde residen los principales problemas con que la recepción de esta Directiva ha tropezado en España. Una recepción en la que el
legislador español, si bien ha seguido al dictado las directrices comunitarias, ha hecho
gala de una descoordinación chocante en el plano interno, incomunicando la Ley de
Servicios y la Ley de cabecera en materia de Administración electrónica; al tiempo que
ha abordado de una manera muy superficial el grave escollo de la brecha que separa
a las distintas Administraciones territoriales, señaladamente las locales, en razón de su
desigual estado de desarrollo electrónico. [-]

The European Union constitutes a firm defender of the need to go
deeply into the deployment of the electronic Administration and the Services Directive
represents in this way one of its more out-standing milestones. In the Directive we find a
set of commands imposed on the States in order to make a deep electronic conversion
of the bureaucratic environment around the administrative intervention on the services
activities. All the formalities and procedures will have to change so that their fulfilment
could be realized at distance. In addition, to stop the serious problem of the merger of
authorizations, it is compulsory to create a point of single contact from which to be able
to obtain information and to complete at distance the different bureaucratic formalities;
a point of single contact that, obviously, has also ended up having an electronic performance.
We are talking, then, about really important obligations, the fulfilment of which
requires of an extraordinary effort from the States, where, far beyond from an active
leadership by a single administration, an interest and a convergence of all the involved
administration is required. Here lie all the problems that the implementation of this
Directive has found in Spain. An implementation in which the Spanish legislator, despite
applying thoroughly the European directives, has shown a shocking lack of coordination
on an internal level, isolating the legislation of Services and the legislation of Electronic
Administration; approaching, at the same time, in a very superficial way the serious
handicap that divides the different regional Administrations, especially the local ones,
because of their uneven electronic development. [-]
