La legislación europea en materia de protección a las víctimas del delito, establece que los menores de edad son víctimas especialmente vulnerables en cualquier circunstancia, independientemente del tipo de delito. En el presente trabajo se pretende determinar, mediante una revisión bibliográfica, cuáles son las medidas de protección procesales que se emplean en España en base a la garantía del interés superior del menor, con el objetivo de minimizar la victimización secundaria a la que estos menores se ven sometidos a causa de su participación en el proceso penal. Atendiendo al derecho del menor a ser escuchado al tiempo que se garantiza el derecho de defensa del acusado, la LOEVD establece la toma de declaración de estas víctimas por medio de expertos, así como la posibilidad de incluir dicho testimonio en la modalidad anticipatoria de la prueba. Se considera que el psicólogo forense dispone de los conocimientos y técnicas más adecuados para llevar a cabo esta exploración, por lo que resulta fundamental la coordinación y colaboración entre los profesionales del derecho y los de la psicología, para reducir las consecuencias negativas de la implicación de los menores en el sistema judicial. European legislation on the protection of victims of crime states that children are particularly vulnerable victims in any circumstances regardless the type of the offense. The present study aims to determine, through a bibliographic review, the procedural protection measures used in Spain specifically aimed at this group. The purpose of these measures is to guarantee the best interests of the child while minimizing the secondary victimization to which these children are subjected because of their participation in the criminal process. Considering the child's right to be heard while guaranteeing the defendant's right to defense, the LOEVD establishes that to take a statement from these victims must be carried out by experts. Likewise, it considers the possibility of including this testimony in the anticipatory modality of the evidence. Forensic psychologists are considered the most suitable professionals to carry out this evaluation because they are the ones with the most appropiate knowledge and training. So, coordination and collaboration between legal and psychology professionals is essential to reduce the negative consequences of the involvement of children in the judicial system. [-]
