Evaluación del menor infractor en el ámbito judicial

Abstract

Se trata de hacer un análisis sobre los aspectos más relevantes del paso de un menor por el sistema judicial español. Destacando del proceso los principios que lo rigen, el papel del equipo técnico, el informe pericial y los instrumentos de evaluación, haciendo un especial énfasis en este último punto, realizando una revisión sistemática de las herramientas de evaluación utilizadas en el contexto español y las principales internacionalmente. En la recopilación de instrumentos nos centramos en los de ámbito forense, dejando de lado herramientas de carácter clínico que también pudieran ser usados en la evaluación dentro del sistema judicial. Los distintos instrumentos han sido seleccionados según su grado de fiabilidad predictiva, su ámbito de aplicación y sus particularidades según su naturaleza. También ha sido tenido en cuenta para su selección su uso en el sistema judicial español, no obstante también se detallarán algunos instrumentos relevantes utilizados en el extranjero. Se presentan dieciocho instrumentos, los cuales están agrupados en tres categorías según su objetivo: Predicción del riesgo de reincidencia violenta o general (SAVRY, IGI-J, YASI, JI-R, PREVI-A, SAPROF:YV, ASSET y MAYSI-2), predicción del riesgo de violencia sexual (ERASOR 2.0, J-SOAP-II, ARMIDILO-S, MEGA y DASH-13) y medición del grado de psicopatía (PCL:YV, APSD, YPI, IM-P y PCS). Como veremos, existe una gran variedad de instrumentos, no obstante sigue sin haber de protocolo único, común y sólido en relación a la aplicación de estos en el proceso de evaluación de los menores.

This is an analysis of the most relevant aspects of a minor's passage through the Spanish judicial system. It highlights the principles that govern the process, the role of the technical team, the expert's report and the evaluation instruments, with a special emphasis on this last point, carrying out a systematic review of the evaluation tools used in the Spanish context and the main ones internationally. In compiling the instruments, we focused on those in the forensic field, leaving aside tools of a clinical nature that could also be used in evaluation in the judicial system. The different instruments have been selected according to their degree of predictive reliability, their scope of application and their particularities according to their nature. Their use in the Spanish judicial system is also relevant for their collection, however some instruments used abroad will also be detailed. Eigtheen instruments are presented, which are grouped into three categories according to their objective: Prediction of the risk of violent or general recidivism (SAVRY, IGI-J, YASI, JI-R, PREVI-A, SAPROF:YV, ASSET and MAYSI-2), prediction of the risk of sexual violence (ERASOR 2. 0, J-SOAP-II, ARMIDILO-S, MEGA and DASH-13) and measuring the degree of psychopathy (PCL:YV, APSD, YPI, IM-P and PCS). As we will see, there is a great variety of instruments, however there is still no single, common and solid protocol in relation to the application of these in the evaluation process of minors.
