Respuesta policial ante la violencia de género

Abstract

La violencia de género continúa siendo un grave problema para la sociedad ya que la continua discriminación y desigualdad que sobre las mujeres recaen, desencadena una serie de resultados perjudiciales ya no solo a la víctima, sino también para la sociedad, ya que se entienden que estos hechos delictivos atentan contra derechos fundamentales y libertades. En este estudio se lleva a cabo un análisis sobre las actuaciones y los medios que emplean las Fuerzas y Cuerpos de Seguridad de todo el territorio español para proporcionar la seguridad y protección que debe tener toda persona víctima de violencia de género. Por todo ello, nos centraremos en estudiar cada una de las unidades especializadas de las que disponen las Fuerzas y Cuerpos de Seguridad, con el objetivo de saber qué actuaciones realizan cada una y cómo en base a ellas, garantizan la asistencia que requiera la víctima y ejecutan todos los mecanismos para hacer efectivas las medidas policiales y judiciales que se hayan asignado de acuerdo a lo que se establece en la Ley Orgánica 1/2004, de 28 de diciembre, de Medidas de Protección Integral contra la Violencia de Género. A continuación, se hablará sobre cómo el sistema de seguimiento integral de los casos de violencia de género, más conocido como el Sistema VioGén, y los múltiples protocolos de valoración del riesgo que se recogen o no en él, son las principales herramientas de las que disponen los agentes de policía para poder darles a las víctimas una respuesta integral, con las que se sientan protegidas y seguras. Para alcanzar ese objetivo, al final se exponen las medidas policiales que se adoptan dependiendo del nivel de riesgo que presente la víctima y la importancia de la orden de protección.

Gender violence continues to be a serious problem for society, since the different forms of discrimination and inequality that fall on women trigger a series of harmful consequences not only for the victim, but also for society, since it is understood that these criminal acts violate fundamental rights and freedoms. In this work, I have made an analysis of the actions and means used by the Security Forces and Bodies of the Spanish territory to provide the security and protection that every person who is a victim of gender violence should have. For all these reasons, we will focus on studying each of the specialized units of the Security Forces and Bodies, with the purpose of knowing what actions each unit has and how, based on them, they provide the assistance required by the victim and execute all the mechanisms to give effect to the police and judicial measures that have been assigned in accordance with Organic Law 1/2004, of December 28, on Protective Measures Comprehensive against Gender Violence. Next, I will talk about Integral Monitoring System in Cases of Gender Violence better known as the VioGén System and the different risk assessment protocols that are included in it or not. These are the main instruments that police officers use to give victims an integral response, so that they feel protected and safe. To achieve this objective, at the end of the work I will talk about the police measures that can be done depending on the level of risk that the victim presents. The importance of the protection order will also be highlighted.
