dc.description.abstract | El domicilio de cualquier persona está protegido constitucionalmente, pero, en el caso de que se estuviera investigando un delito, existen excepciones en las cuales los Agentes de la autoridad pueden acceder a él. La entrada y registro al domicilio se convierte en un acta que, a la hora del juicio oral, puede servir como prueba esclarecedora, pero se deben cumplir todos los requisitos constitucionales y procesales para llegar a eso. Por lo tanto, en el siguiente trabajo empiezo remarcando el derecho fundamental a la inviolabilidad del domicilio y que se entiende por éste ya que no todos los lugares y espacios cerrados se pueden considerar como tal, porque también hay que tener en cuenta que no es lo mismo entrar en un lugar considerado domicilio, como, por ejemplo, una morada, que en una casa abandonada o deshabitada. El art. 18.2 de la Constitución Española indica que el domicilio es inviolable puesto que ninguna entrada y registro podrá hacerse sin consentimiento del titular, resolución judicial y en el caso de delito fragante. La legislación ordinaria que regula procesalmente la entrada y registro es la LECRIM, en sus artículos 545 y ss. Pueden existir problemáticas a la hora de efectuar la entrada y el registro ya que hay que tener en cuenta varios factores como qué clase de domicilio es, la situación del destinatario, etc. Lo que hay que tener siempre en cuenta es que es un derecho fundamental que se puede ver afectado y hay que tener razones fundadas para solicitar la entrada y registro a través de autorización judicial, en el caso de que el titular o interesado denegare su entrada, porque si la diligencia no se lleva a cabo correctamente no valdría como prueba preconstituida a la hora del juicio oral y con ello puede que no se compruebe correctamente la implicación del acusado en el delito. | ca_CA |
dc.description.abstract | The domicile of any person is constitutionally protected, but in the event that an offence is under investigation, there are exceptions in which the agents of the authority may have access to it. The entry and search of the home becomes a record which, at the time of the oral proceedings, can serve as illuminating evidence, but all constitutional and procedural requirements must be met in order to arrive at that. Therefore, in the following work I begin by emphasizing the fundamental right to the inviolability of the home and which is understood by this since not all places and closed spaces can be considered as such, because it is also important to bear in mind that it is not the same to enter a place considered as a domicile, such as a dwelling, than in an abandoned or uninhabited house. Art. 18.2 of the Spanish Constitution indicates that the domicile is inviolable since no entry and search may be made without the consent of the owner, judicial decision and in the case of a fragrant crime. The ordinary legislation regulating entry and registration is the LECRIM, in its articles 545 et seq. There may be problems when entering and registering as several factors have to be taken into account, such as what kind of address it is, the situation of the recipient, etc. What must always be taken into account is that it is a fundamental right that can be affected and one must have good reason to request entry and registration through judicial authorization, in the event that the holder or person concerned refuses entry, because if the procedure is not carried out correctly, it would not be used as a preestablished piece of evidence at the time of the oral proceedings and thus the involvement of the accused in the offence may not be correctly established. | ca_CA |
