El artículo 88 de la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales (LOPDGDD), con mucho más empeño en la forma que en el fondo, reconoce a los trabajadores y empleados públicos el «derecho a la desconexión digital a fin de garantizar, fuera del tiempo de trabajo legal o convencionalmente establecido, el respeto de su tiempo de descanso, permisos y vacaciones, así como de su intimidad personal y familiar». En el momento en que vio la luz, esta previsión, no obstante, no resultaba totalmente innovadora, puesto que el derecho a la desconexión digital ya había sido recogido por la Ley francesa 2016-1088, de 8 de agosto de 2016, de reforma del Código de Trabajo –en la que se inspira aunque no copia– y, dentro del panorama nacional, por el Convenio colectivo del Grupo AXA Seguros, publicado el 10 de octubre de 2017, al que en el momento de la aparición de la ley ya habían seguido otros. En cualquier caso, el reconocimiento a nivel normativo de
este derecho tenía la relevancia de introducirlo en el marco jurídico general, al suponer su proyección sobre todos «los trabajadores y empleados públicos». Con todo, en el plano de las realizaciones efectivas, lo cierto es que poco añadió a su mera declaración formal. [-]

Section 88 of the Spanish Organic Law 3/2018, of 5 December, on the protection of personal data and guarantee of digital rights (LOPDGDD) recognises, with much more emphasis on its form than on its content, the "right of third party employees and civil servants to be digitally disconnected in order to guarantee, outside the legally or conventionally established working time, the respect for their leisure time, leave and holidays, as well as their personal and family privacy". Yet, at the time it was issued, this provision was not entirely innovative, since the right to digital disconnection had already been established by the French Law 2016-1088, of 8 August 2016, on the reform of the Labour Code. The Spanish provision was inspired by its French counterpart, yet not copied. Another domestic precedent in Spain was AXA Seguros Group's collective agreement, published on 10 October 2017, which had already been followed by other companies when said law was issued. In any case, the recognition of this right within the Spanish overall legal framework was an important event in the country since it allowed the right to be applied to every “third party employee and civil servant”. However, in terms of actual achievement, the truth is that it added little besides its formal aspects. [-]
