El papel de los Tribunales Constitucionales en la gobernanza a diferentes niveles. España: el Tribunal Constitucional

Abstract

El Tribunal Constitucional, máximo intérprete de la Constitución española de 1978, se configura como un órgano constitucional de naturaleza jurisdiccional, compuesto por doce magistrados nombrados entre juristas de reconocida competencia con una trayectoria profesional superior a quince años, y cuyo mandato, como regla general, tiene una duración de nueve años. Dichos magistrados son independientes y deben ejercer su función conforme al principio de imparcialidad, estableciéndose normativamente diversas garantías parahacer efectivas tales exigencias. The Constitutional Court, the highest interpreter of the Spanish Constitution of 1978, is configured as a constitutional body of a jurisdictional nature, made up of twelve magistrates appointed from among jurists of recognised competence with a professional career of more than fifteen years, and whose mandate, as a general rule, lasts for nine years. These magistrates are independent and must exercise their function in accordance with the principle of impartiality, and various guarantees are established by law to give effect to these requirements. This report was prepared by one of the rapporteurs at the forum on "The role of constitutional courts in multilevel governance", organised by the Comparative Law Library Unit of the Research Service of the European Parliament on 18 November 2016.
