El régimen disciplinario penitenciaro: análisis crítico y propuestas de reforma

Abstract

En el presente trabajo se estudian las posibles vulneraciones de los principios de non bis in ídem, de tipicidad y de reserva de ley de la normativa disciplinaria penitenciaria. Tras el análisis normativo, doctrinal y jurisprudencial, se puede concluir que los dos reglamentos que determinan la materia vulneran el principio de legalidad por regular materias limitadoras de derechos y libertades fundamentales que solo pueden recogerse en leyes orgánicas como único medio para preservar la reserva de ley, a pesar de que el Tribunal Constitucional lo justifica por la relación de sujeción especial. Asimismo, solo es posible sancionar por vía administrativa y, además, por vía penal, cuando cada una proteja bienes jurídicos diferentes, sino se lesionará el principio de non bis in ídem. El principio de tipicidad se vulnera con la previsión de la infracción disciplinaria que contempla la analogía, por el uso habitual de términos que favorezcan juicios subjetivos en la descripción de las conductas, así como con la utilización extensiva de normas reglamentarias para la regulación de la materia. Además, se constata que es necesaria una unificación de las normas reguladoras del régimen disciplinario penitenciario para facilitar su aplicación práctica, así como su actualización a la realidad actual de los establecimientos penitenciarios.

In the present work the possible violations of the principles of non bis in idem, of typicity and legal reserve of the penitentiary disciplinary regulations are studied. After the normative, doctrinal and jurisprudential analysis, it can be concluded that the two regulations that regulate the matter break the principle of legality by regulating matters that restrict rights and fundamental freedoms that can only be included in organic laws as the only means to preserve the legal reservation, in spite of the Constitutional Tribunal justifies it by the special subject relationship. Moreover, it is only possible to sanction administratively and, in addition, by criminal law, when each one protects different legal assets, otherwise the principle of non bis in idem will be broken. The principle of typicity is broke with the forecast of the disciplinary infraction that contemplates the analogy, for habitual use of terms that benefit subjective judgments in the description of the conducts, as well as with the extensive use of regulatory norms for the regulation of the matter. In addition, it is noted that it is necessary to unify the penitentiary disciplinary regulations system to facilitate its practical application, as well as its updating to the current reality of the penitentiary establishments.
