LET US OUT. Intervention program based on resilience theories for juvenile offenders.

Abstract

Although in Spain the "minor of reform" and the "minor of protection" are socially and criminally differentiated since the 20th century, at present the "minors of protection" show an over-representation in the Justice System. This may be due to the social variables of risk and the psychological imbalance that both share, however, not all children who have these risk factors end up delinquent. It is the paradox of resilience that explains how these minors face their daily tests, without starting a criminal career, through the development and strengthening of their protective factors. Therefore, it is considered necessary to propose an intervention programme based on the theories of resilience for its possible implementation in open prison centers, specifically in probation. "Let Us Out" aims to enable these young people to develop resilient skills and tools to cope with their life circumstances. For one year, a set of individual and group theoreticalpractical activities would be carried out for the young people and their families, related to family, extra-family and individual protection factors. The evaluation would follow a pre-post methodology, with the post measured in two times, through the evaluation instruments IGIJ (Garrido, López and Silva, 2004), SAPROF-YV (De Vries, Geers, Stapel, Hilterman and de Vogel, 2007; translation 2015) and RS (Wagnild, 2009). The urgency of such programs lies in the need for these young people to be treated from a more caring and educational approach. However, the problem covers the political and social sphere, which entails a lack of resources and the stigmatization of these minors, which will only be alleviated by social education from childhood onwards.

Aunque en España el “menor de reforma” y el “menor de protección” están diferenciados social y penalmente desde el s.XX, en la actualidad los “menores de protección” muestran una sobrerrepresentación en el Sistema de Justicia. Esto puede deberse a las variables sociales de riesgo y el desajuste psicológico que ambos comparten, sin embargo, no todos los menores que cuentan con estos factores de riesgo acaban delinquiendo. Es la paradoja de la resiliencia la que explica cómo estos menores afrontan sus pruebas diarias, sin iniciar una carrera delictiva, a través del desarrollo y la potenciación de sus factores de protección. Por lo tanto, se considera necesario proponer un programa de intervención basado en las teorías de la resiliencia para su posible implantación en los centros de medidas de medio abierto, concretamente en la Libertad Vigilada. “Dejadnos salir” tiene como objetivo que estos jóvenes desarrollen capacidades resilientes y herramientas para afrontar sus circunstancias vitales. Durante un año se llevaría a cabo un conjunto de actividades teórico-prácticas, de carácter individual y grupal, para los jóvenes y para sus familias, relacionadas con los factores de protección familiares, extrafamiliares e individuales. La evaluación seguiría una metodología pre-post, con el post medido en dos tiempos, a través de los instrumentos de evaluación IGI-J (Garrido, López y Silva, 2004), SAPROF-YV (De Vries, Geers, Stapel, Hilterman y de Vogel, 2007; traducción 2015) y RS (Wagnild, 2009). La urgencia de programas de estas características reside en la necesidad que tienen estos jóvenes de ser tratados desde un enfoque más cuidador y educacional. Sin embargo, la problemática abarca la esfera política y social, lo que conlleva una falta de recursos y la estigmatización de estos menores, lo cual solo se paliará con educación social desde la infancia.
