El presente trabajo tiene por finalidad el estudio de la detención como medida

El presente trabajo tiene por finalidad el estudio de la detención como medida
precautelar personal. Es por lo que se analizará en primer lugar el concepto y su
diferencia con la retención, la finalidad perseguida, los presupuestos formales y materiales
que la habilitan, las modalidades previstas legalmente en la Ley de Enjuiciamiento
Criminal, así como los presupuestos que condicionan su aplicación. Del mismo modo se
examinarán las garantías y derechos que asisten al detenido y avalan la legalidad de la
detención.
Se hará referencia también a la libertad deambulatoria consagrada en el artículo
17.1 de la Constitución Española, puesto que está sometida a consecuencias negativas
derivadas del procedimiento de la detención.
Del mismo modo se examinará el procedimiento de Habeas Corpus, instrumento a
través del cual el detenido que discurra sobre la ilegalidad de la detención, es puesto
inmediatamente ante la Autoridad Judicial y solicita la inspección de las circunstancias en
que se ha realizado la misma.
Y por último, la Orden Europea de Detención y Entrega, como instrumento
imprescindible que facilita, simplifica y agiliza la colaboración y cooperación entre Estados
miembros de la Unión Europea en relación a la solicitud por parte de un Estado requirente
del detenido para ser juzgado o para llevar a cabo el cumplimiento de condena por el
Juzgado del Estado competente. [-]

The purpose of this paper is to study detention as a personal precautionary
measure. That is why the concept and its difference will be analyzed in the first instance
with the retention, the purpose pursued, the formal and material budgets that enable it, the
modalities provided by law in the Criminal Procedure Act, as well as the restrictions that
condition their application. In the same way, the guarantees and rights that assist the
detainee and guarantee the legality of the detention will also be examined.
Reference will also be made to the deambulatory freedom enshrined in Article 17.1
of the Spanish Constitution, since it is subject to negative consequences derived from the
detention procedure.
In the same way, the Habeas Corpus procedure will be examined, an instrument
through which the detainee, who has discussed the illegality of the detention, is placed immediately before the Judicial Authority and requests the inspection of the circumstances
in which it has been carried out.
And finally, the European Order of Detention and Delivery will be examined, as an
essential instrument that facilitates, simplifies and expedites collaboration and cooperation
between Member States of the European Union in relation to the request by a requesting
State of the detainee to be tried or to carry out the execution of sentence by the competent
State Court. [-]
